The Kate Farms Prize Pack Sweepstakes OFFICIAL RULES
NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.
1. Eligibility: The Kate Farms Prize Pack Sweepstakes (“Sweepstakes”) is open only to legal residents of the United States (excluding residents of Rhode Island), who are 18 years of age and older at the time of entry. Employees, officers, and directors of Kate Farms, Inc. (“Sponsor”) and its parents, subsidiaries, affiliated companies, advertising, promotion, or production agencies (and the IRS dependents, immediate family members and individuals residing in the same household as any of the foregoing persons), and health care providers are not eligible to participate. All applicable federal, state and local laws apply. By participating, you agree to be bound by these Official Rules. Void where prohibited.
2. Entry Period: From 06/27/2023 at 12:00:01 a.m. Pacific Time ("PT") through 06/30/2023at 11:59:59 p.m. PT (the “Sweepstakes Period”).
3. How to Enter: There is one (1) way to enter.
To enter the Sweepstakes, fill out the entry form using the iPad located at the Kate Farms Booth at the Oley 2023 Conference , including entrant’s full name, email address, and communication preferences. Incomplete entries are void.
Limit one (1) entry per person, regardless of method of entry. Additional attempts to submit an entry from the same person are void and may result in disqualification. No responsibility is assumed for lost, late, misdirected, incomplete, or damaged entries or for any failed or interrupted electronic communications. Proof of submission is not proof of receipt. Entries will not be acknowledged or returned.Participation constitutes entrant’s full and unconditional agreement to these Official Rules and to judges’ decisions, which are final and binding in all matters related to the Sweepstakes. Winning a prize is contingent upon fulfilling all requirements set forth herein. Use of any macro, bot, script or other automated means to submit entries is prohibited. Each entry will be deemed submitted by the authorized account holder of the email account associated with the entry. An “authorized account holder” is defined as the natural person to whom the email address is assigned by an internet service provider, online service provider or other organization that is responsible for assigning email addresses for the domain associated with the submitted email address.
4. Winner Selection and Notification: The winner of the Sweepstakes will be randomly selected on or about 07/11/2023 among all eligible entries. Potential winner will be notified and contacted via email from lauren.roche@katefarms.com on or about 07/11/2023.
No liability is assumed for any winner notification that is lost, intercepted or not received by a potential winner for any reason. Failure to respond to any winner notification within 72 hours may result in disqualification and selection of an alternate winner. Potential winner may be required to execute an Affidavit of Eligibility, a Liability Release, and a Publicity Release (“Prize Claim Documents”). If any eligible winner is not of legal age of majority in their state of residence, at Sponsor’s option, the applicable prize either may be awarded in the name of parent or legal guardian of winner, or parent or legal guardian of winner may be required to ratify and sign all Prize Claim Documents. Failure to comply when requested may result in disqualification and selection of an alternate winner.
5. Prize/Odds:1 prize is available:
One Kate Farms Prize Pack valued at $150: One bag of Kate Farms branded items (tote bag, journal, water bottle, candle, $50 Amazon gift card, and hat).
Prize is non-transferable and no substitution by winner or cash equivalent is allowed. Sponsor reserves the right to substitute prize for one of equal or greater value if the advertised prize becomes unavailable. Winner is solely responsible for the payment of all federal, state, and local taxes and any expenses or costs not expressly set forth above. No responsibility is assumed for any events beyond Sponsor's control.
Odds of Winning. Odds of winning depend on the number of eligible entries.
6. Additional Rules: Entry materials/data that have been tampered with or altered are void. No responsibility is assumed for: (i) lost, late, misdirected, damaged, garbled, incomplete or illegible entries, all of which are void; (ii) error, omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, mobile device, computer, hardware or software malfunctions of any kind, or inaccurate transmission of or failure to receive entry information by Sponsor on account of technical problems; or (iii) any injury or damage to entrant's or any other person's mobile device related to or resulting from participating in the Sweepstakes.
By participating, you (i) agree to be bound by these Official Rules, including all eligibility requirements, and (ii) agree to be bound by the decisions of the judges, which are final and binding in all matters relating to the Sweepstakes. Failure to comply with these Official Rules may result in disqualification from the Sweepstakes. Sponsor reserves the right to: (i) permanently disqualify from any Sweepstakes it sponsors any person it believes has intentionally violated these Official Rules; and (ii) suspend, modify or terminate the Sweepstakes if Sponsor believes, in its sole discretion, that malfunction, error, disruption or damage is impairing or will impair the administration, security, fairness, integrity or proper conduct of the Sweepstakes. Except where prohibited, participation in the Sweepstakes and/or receipt or use of any prize further constitutes each winner’s consent for use of their name, likeness, voice, opinions, statements, biographical information, and/or hometown and state for promotional or advertising purposes in any media, worldwide, now known or hereafter developed, in perpetuity, without further review, notification, payment, or consideration (unless prohibited by law).
Any individual who is found to be tampering with the entry process or the operation of the Sweepstakes, to be acting in violation of these Official Rules, or to be acting in an unsportsmanlike or disruptive manner, or with the intent to disrupt or undermine the legitimate operation of the Sweepstakes, or to annoy, abuse, threaten or harass any other person, may be disqualified, and Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law.
Sponsor reserves the right to modify, extend, suspend, or terminate the Sweepstakes, in whole or in part, if it determines, in its sole discretion, that the Sweepstakes is technically impaired or corrupted or that fraud or technical problems, failures or malfunctions or other unintended circumstances have impaired the integrity, administration, security, proper play and/or feasibility of the Sweepstakes as contemplated herein. If the Sweepstakes is terminated before the designated end date, Sponsor will (if possible) select winner(s) in a random drawing from all eligible, non-suspect entries unaffected by the problem. Inclusion in such drawing shall be each entrant’s sole and exclusive remedy in such circumstances.
7. Release of Liability: To the extent permitted by applicable law, by participating, you (and if you are a minor, your parent or legal guardian) release Sponsor and its parent companies, subsidiaries, affiliates, partners, employees, directors, agents, advertising agencies, and all others associated with the development and execution of this Sweepstakes from any and against any and all injury, loss or damage caused or claimed to be caused by your participation in the Sweepstakes and/or the acceptance, awarding, receipt, use and/or misuse of the prize, and you agree that these entities are not responsible for any warranty, representation, or guarantee, expressed or implied, in fact or in law, relating to the promotion and/or the awarding of any prize except as expressly provided in these Official Rules. To the extent permitted by applicable law, by participating, you agree that: (a) any and all disputes, claims, and causes of action arising out of or in connection with the Sweepstakes, or any prizes awarded, shall be resolved individually without resort to any form of class action; (b) any claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Sweepstakes, but in no event attorney’s fees; (c) under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby waives all rights to claim, punitive, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than damages for actual out-of-pocket expenses; and (d) these Rules and all disputes shall be governed by the internal laws of the state of California, without regard to principles of conflicts of laws, any disputes shall be resolved exclusively in the state or federal courts in the state of California, and you expressly consent to the jurisdiction of said courts and waive any objection thereto. For New Jersey Residents: Nothing herein prohibits recovery of damages or attorneys’ fees where required by statute.
8. Data: Any information you submit is subject to Sponsor’s privacy policy located at /policy/privacy-policy/.
9. Winner Name: For the name of the winner, send a self-addressed stamped envelope to Kate Farms Prize PackSweepstakes, Kate Farms, Inc., Attn: Legal Department, 30 S. La Patera Lane Unit 5 Goleta, CA 93117. All such requests must be received within 60 days after the end of the Sweepstakes.
